1. Who we are
Mindset Mantras is a trading name of [full legal name of the business or sole trader][if a company: a company registered in England and Wales, company number 00000000], whose address is [geographic address, not a PO box]. [if VAT registered: VAT number GB000000000]
In these terms, "we", "us" and "our" mean Mindset Mantras, and "you" means the person buying or using our products. You can contact us at hello@mindsetmantras.store.
2. These terms
These terms apply to every purchase you make from us and to your use of our albums and website. Please read them, together with our refund policy, disclaimer and privacy policy, before you buy. By placing an order, you agree to them.
You must be 18 or over to buy from us. Our products are sold to consumers for personal use. If you buy on behalf of a business, please contact us first.
3. Our products
- Ready-made albums: albums of spoken affirmations set to music, supplied as digital audio files and accompanying documents, as described on our website.
- Personalised albums: albums made for you using details you provide, such as your first name, business name, chosen challenges and narrator.
- Bespoke tracks and albums: written from scratch for an event or around your story. These are not yet available, and will have their own terms, which we will give you before you order.
We try to describe our products accurately, but small differences in sound may occur depending on your device and speakers. Preview clips and voice samples are representative of the finished product.
4. Ordering and payment
Our online store is operated by Lemon Squeezy, which acts as our authorised reseller and merchant of record. When you buy, you pay Lemon Squeezy, and your purchase is also subject to Lemon Squeezy's buyer terms. Lemon Squeezy handles payment, sales tax and VAT, and receipts. We supply the album and provide support for it.
Prices are shown on our website. Any sales tax or VAT due in your country is calculated and shown at checkout before you pay. Your order is accepted when you receive an order confirmation email.
If we discover a clear pricing error before your album is delivered, we will contact you and either supply it at the correct price, if you agree, or cancel the order and refund you in full.
5. Delivery
- Ready-made albums are delivered immediately after payment by a download link sent to the email address you give at checkout.
- Personalised albums are usually delivered by email within 24 hours of your order, and in any case within [maximum number] working days. If there is a delay, we will tell you.
Please download and save your files when you receive them, and keep your own copy. Download links may expire after a period of time.
6. Personalised albums
When you order a personalised album, you are responsible for making sure the details you give us are accurate and spelled correctly. We will use them exactly as you enter them, and we will show you a summary to check before you pay.
You must only give us names you have the right to use, normally your own name and the name of your own business. You must not ask us to include anything offensive, abusive, unlawful, defamatory or that infringes someone else's rights. We review personalised details before production and may refuse or cancel an order, with a full refund, if we reasonably believe they break this section.
We use your details only to make and deliver your album, as explained in our privacy policy.
7. Your licence to use our albums
We, or our licensors, own all rights in our albums, including the music, recordings, scripts and artwork. When you buy an album, we give you a non-exclusive, non-transferable licence to download it, copy it onto your own devices and listen to it for your own personal, non-commercial use.
You may not:
- sell, share, give away, lend or distribute the files or scripts, or let other people download them;
- upload or stream them publicly, including to streaming services, social media, podcasts or video platforms, other than short clips of a personalised album for personal, non-commercial sharing;
- play them in public or as part of a paid service, class, event or business, without our written permission;
- copy, edit or remix them except for your own private listening; or
- use them, or any part of them, to train or develop artificial intelligence or machine learning systems.
This licence lasts as long as you follow these terms.
8. Cancellation and refunds
Because our albums are digital content, you lose your right to cancel once a download is made available to you, or, for a personalised album, once production begins. You will be asked to agree to this when you order. All sales are final, but if there is a problem with your album, we will put it right. Full details are in our refund policy, which forms part of these terms.
9. Health, safety and results
Our albums are a self-help tool for everyday mindset. They are not medical treatment, therapy, or business, financial or legal advice, and we do not guarantee any particular result. Never listen while driving or operating machinery. Please read our disclaimer, which forms part of these terms.
10. Our website
We aim to keep our website available and accurate, but we do not guarantee that it will always be available, uninterrupted or free of errors. Links to other websites are provided for convenience, and we are not responsible for their content. You must not misuse our website, for example by trying to gain unauthorised access to it or by introducing viruses.
11. Our responsibility to you
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. Loss or damage is foreseeable if it is obvious it would happen, or if both of us knew it might happen when you placed your order.
- Our products are for personal use. We are not responsible for any loss of profit, loss of business, business interruption or loss of business opportunity.
- If digital content we supply damages a device or other digital content belonging to you because we did not use reasonable care and skill, we will either repair the damage or pay you compensation.
- Except where the law says otherwise, our total responsibility to you for any order is limited to the price you paid for it.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights as a consumer, or for anything else that cannot be limited or excluded by law. If you live outside the UK, some of these limits may not apply to you, and you keep any rights your local laws give you that cannot be excluded.
12. Your information
We only use your personal information as set out in our privacy policy.
13. Changes to these terms
We may update these terms from time to time, for example to reflect changes in the law or our products. The terms that apply to your order are the ones shown on our website when you placed it.
14. Law and disputes
These terms are governed by the law of England and Wales. If you live in the UK, you can bring proceedings in the courts of the part of the UK where you live. If you live in the European Union or elsewhere, you also keep the protection of the mandatory consumer laws of the country where you live, and you can bring proceedings in your own country's courts where your local law allows this.
If you have a complaint, please contact us first at hello@mindsetmantras.store so we can try to resolve it. If either of us does not enforce a right under these terms straight away, that does not stop us enforcing it later. If any part of these terms is found to be unenforceable, the rest will still apply.
